A caregiver who had sex with a 16-year-old boy who was supposed to care for lost and opportuMartin denied the allegations of engaging in sexual activities while in a position of trust and sent a sexual communication and went to trial in the Lanark Sheriff’s Court. She was convicted by Sheriff Nikola Stewart and in April she was placed on the sex offender registry for two years, forbidden to contact the teenager and ordered to perform 250 hours of unpaid work. She launched an attempt to revoke the conviction in the Sheriff’s Court of Appeals in Edinburgh but was rejected before a full hearing could take place. Martin, of Hamilton, has now appeared in the Hamilton Sheriff’s Court, where Sheriff Vincent Smith granted him another nine months to complete his unpaid work. Ian Scott, in defense, said: “ His appeal in this matter has ended because he failed to pass the screening stage.ity to revoke his sentence.

‘We are asking the court to grant her an extension to allow her to complete the court order she was given.’

Sentencing her, Sheriff Stewart blasted Martin’s ‘appalling behavior’ adding: ‘This was a serious relationship regardless of what she thought it was.

‘He is a young man who has an attractive, caring young woman who was giving him a highly unusual amount of attention and the warning bells should have been ringing much earlier.

‘I don’t think she is predatory but is someone who is naive and foolish.

‘I have no doubt that this will have undoubted serious repercussions on his life and frankly this is a dreadful thing she has done.

‘The benefit of her education has now been entirely wasted. I regard this appalling behavior very seriously and can’t say enough how worried I am about the repercussions of this on this young man’s life.’

The Sheriff’s Court of Appeals confirmed that Martin’s case had been rejected in the ‘second stage of review’ of the appeal process.
