Dennis will not face charges for the incident, Santa Rosa County Sheriff Bob Johnson announced at a Thursday news conference.  Johnson said Bergan, who is married to Dennis’ daughter and has a son and lives in Norway, arrived at a Florida airport on Tuesday evening and went straight to his father-in-law’s home.

Christopher Bergan, 37, had just flown from his native Norway to surprise Richard Dennis, 61, at his home in Gulf Breeze, Florida, on Tuesday night.

Richard Dennis fired one round, striking Christopher Bergan in the chest in his backyard.

Richard Dennis had had an altercation earlier that night with a family member, police say.

“I’m not going to second guess Richard Dennis for what he did,” Santa Rosa County Sheriff Bob Johnson told a news conference on Thursday.

“Here he is, he had just had a confrontation at the front of his house,” said the lawman.

He said Richard Dennis had had an argument with a family member around 21:36 (01:36 GMT) on 1 October.

That relative had banged on Richard Dennis’ front door in a manner similar to how Christopher Bergan later did on the backdoor, the sheriff said.

Christopher Bergan had arrived at 23:00 that night from Norway, where he lived with Richard Dennis’ daughter.

He wanted to surprise his father-in-law for his 61st birthday.

Officials say he went straight to Richard Dennis’ house after landing at the airport.

Christopher Bergan banged on the backdoor, before jumping out of bushes “growling” as Richard Dennis turned the rear porch light on, the sheriff continued.

He said the backyard is enclosed by a fence.

“Our investigation has revealed that this was totally accidental,” said Sheriff Johnson.

“It was a really sad occurrence and no charges are warranted in this case.”

“You can’t really say anything against Richard Dennis for doing what he did,” he added.

Friends have posted tributes to Facebook, blaming his death on ‘gun culture in America’. One friend wrote: ‘My childhood buddy, Chris Bergan, was killed accidentally by a family member. He had no idea he was shooting his son-in-law. I’m convinced gun culture has everything to do with this tragedy.

‘Please think about the way you talk about guns and consider dropping the gun pride. Teach your kids they are tools, not toys.’

When contacted by DailyMail.com, police said: ‘The family is obviously in mourning over this tragic incident. They want to express that the two people involved, the deceased and the person with the weapon, were very close family members and that they are looking for privacy at this difficult time.’
