Christopher Smelser, was charged on Friday with involuntary manslaughter in the death of Antonio Valenzuela on February 29. The same day, the Las Cruces Police Department submitted a letter of intent to fire Smelser.

Body camera footage obtained Sunday shows a New Mexico police officer telling a man he’s going to “choke you out” before allegedly causing his death with what authorities described as a “vascular neck restraint.”

In a statement, Chief Patrick Gallagher cited the findings of an autopsy report, which he received on June 4, listing Valenzuela’s cause of death as “choking injuries due to physical restraint,” according to documents obtained by NBC News. . Gallagher added that the department immediately banned the use of vascular neck restraint. The methamphetamines found in the Valenzuela system also contributed “significantly” to his death, says the autopsy.

A spokeswoman for the New Mexico Office of the Medical Investigator, who performed the autopsy on Valenzuela’s death, said death investigations generally take six to 10 weeks or more. In a statement, the Third Judicial District Prosecutor’s office said that Valenzuela’s death occurred after a traffic stop. Valenzuela was wanted for a parole violation and fled from officers, according to the statement.

Officers used a stun gun twice that did not affect Valenzuela, the statement said. During an ensuing fight, Smelser wore a collar to control him, the statement said. In video footage obtained by NBC affiliate KOB, Smelser can be heard saying to Valenzuela, “I’m going to scare you, brother.” Valenzuela can be heard breathless.

Four officers have been charged in Floyd’s death, including Derek Chauvin, the officer who kneeled on Floyd’s neck. He is charged with second-degree murder and other crimes.
